When a person dies they are deemed to have disposed of all of their capital property immediately before death at its fair market value at that time unless it passes by default to the surviving spouse. There are many tax planning opportunities here which should not be overlooked. In addition the tax rules are relaxed for the deceased allowing deductions not permitted while alive.
